A: The Provincial Court of BC (Small Claims Court) has a jurisdictional limit of $35,000.  That means claims over $35,000 must proceed in the Supreme Court of British Columbia? Claims under $5,000 are generally handled by the Claim Resolution Tribunal.

A: If you are seeking more than $35,000, but wish to start your action in Small Claims Court, you can abandon the amount over $35,000 by specifically indicating so in your Notice of Claim, however, once abandoned, you cannot add that amount back into your claim.

A: You can include those amounts together if they do not amount to over $35,000.

A: If there is no contractual interest owing, you can claim interest pursuant to the Court Order Interest Act.  It is a good idea to include a claim for interest in your Notice of Claim to be clear about what amounts you are seeking.
